The League, in partnership with the Performing Arts Alliance, is a member of the <a href=\"https:\/\/www.nivassoc.org\/fixthetix\"><strong>Fix the Tix Coalition<\/strong><\/a>, and is analyzing all active proposals for the impact on orchestras. We are supporting immediate action to stop predatory activity in the secondary market that is hurting audiences and creating substantial financial and reputational harm to orchestras, as described in <em>Symphony<\/em> coverage of <a href=\"https:\/\/urldefense.proofpoint.com\/v2\/url?u=https-3A__symphony.org_features_how-2Dorchestras-2Dare-2Dbattling-2Dconcert-2Dticket-2Dscams_&amp;d=DwMFaQ&amp;c=euGZstcaTDllvimEN8b7jXrwqOf-v5A_CdpgnVfiiMM&amp;r=ITNqzxRGmOV1gHiCZCea9fLL_i6gddeUAH8noq_bCTQ&amp;m=gUYHB4JxqD_oGUa61uLtZF2AfmizemlxPGWWMAwxSvvGNSG5nz5pliXL1Rq-BaD5&amp;s=3K3VQw-DMzdcmFCBUCROrge67oXK9tD6y01fscEUOlg&amp;e=\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>orchestras battling ticket scams<\/strong><\/a>. The League is also watching the fine print of all proposals to make sure new transparency requirements will support nonprofit and season-based ticket sales models.<\/p>\n\n\n\n<p><strong>Federal Trade Commission Announces New Ticket Sales Rules<\/strong><br>The Federal Trade Commission (FTC) has <strong><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/12\/federal-trade-commission-announces-bipartisan-rule-banning-junk-ticket-hotel-fees\">announced new national rules<\/a><\/strong> for marketing and sales of live-event tickets and short-term lodging, following scrutiny of hidden fees. The core content of the rules begins on page 309 of the <strong><a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/r207011_udf_rule_2024_final_0.pdf\">full rulemaking announcement<\/a><\/strong>. <strong>The final rules go into effect May 12, 2025 <\/strong>and will require sellers to clearly communicate the total price of items for sale where prices are displayed and advertised, to accurately represent the nature, purpose, and amount of fees that are charged, and to clearly disclose the final amount of payment for the transaction. (Government charges, shipping charges, and optional fees or charges may be excluded from the total price.) Many states have similar requirements in place or under consideration.<br><br>The League, in partnership with the wider nonprofit performing arts sector, analyzed the initial proposed rules and submitted comments to the FTC in February 2024 to surface questions about how the rules would be applied to the nonprofit, subscription-based, and donor-supported ticketing models, and to go on record with concerns related to predatory activity in the secondary ticket sales market unaddressed by the FTC&#8217;s action. In announcing the final rules, the FTC has signaled that while FTC&#8217;s jurisdiction is specific to profit-making enterprises, it &nbsp;is empowered by Congress to \u201cprevent persons, partnerships, or corporations\u201d from engaging in \u201cunfair or deceptive acts or practices in or affecting commerce.\u201d<\/p>\n\n\n\n<p>The League will continue to analyze this recent FTC action and share further FTC resources as they become available.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.federalregister.gov\/documents\/2025\/01\/10\/2024-30293\/trade-regulation-rule-on-unfair-or-deceptive-fees\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>FTC Final Live-Event Ticket Rules on Unfair or Deceptive Fees<\/strong><\/a> \u2013 (1\/10\/2025)<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/www.ftc.gov\/business-guidance\/resources\/rule-unfair-or-deceptive-fees-frequently-asked-questions\">FTC Business Guide: FAQ on Ticket Rules<\/a><\/strong> &#8211; (05\/01\/2025)<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/www.ftc.gov\/business-guidance\/blog\/2024\/12\/getting-bottom-line-ftcs-bipartisan-junk-fees-rule-your-business\">FTC Summary of Fee Rules<\/a><\/strong> \u2013 (12\/17\/2024)<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/americanorchestras.org\/wp-content\/uploads\/2024\/02\/Nonprofit-Performing-Arts-Comments-FTC-Fee-Rule.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Nonprofit Performing Arts Sector Comments Submitted by League and National Partners<\/a><\/strong> in response to <strong><a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/11\/09\/2023-24234\/trade-regulation-rule-on-unfair-or-deceptive-fees\" target=\"_blank\" rel=\"noreferrer noopener\">FTC Draft Rules for Ticket Sales<\/a> <\/strong>\u2013 (02\/07\/24)<\/li>\n<\/ul>\n\n\n\n<p><strong>Executive Order Calls for Ticketing Reform<\/strong><br>A March 31, 2025\u00a0<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/03\/combating-unfair-practices-in-the-live-entertainment-market\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Executive Order Combatting Unfair Practices in the Live Entertainment Market<\/strong><\/a>\u00a0calls for policy enforcement and potential new regulatory action to curtail activity in the secondary ticket market that harms audiences and artists. The order also states that the White House is \u201ccommitted to making as accessible as possible the arts and entertainment that enrich Americans\u2019 lives.\u201d\u00a0<a href=\"https:\/\/www.whitehouse.gov\/fact-sheets\/2025\/03\/fact-sheet-president-donald-j-trump-will-end-price-gouging-by-middlemen-in-the-entertainment-industry\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>A related fact sheet<\/strong><\/a>\u00a0outlines intentions to enforce current law and calls for a report before October 1, 2025 to recommend further regulatory and legislative action needed. On July 7, the League submitted comments in partnership with a dozen national organizations in\u00a0the nonprofit performing arts sector in response to a recent <a href=\"https:\/\/www.regulations.gov\/document\/ATR-2025-0002-0002\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>request for information<\/strong><\/a> from the Department of Justice (DOJ) and FTC regarding ticketing for live events. The executive order directs the federal agencies to prepare recommendations to combat unfair and anticompetitive practices, and future regulatory or legislative recommendations may prompt\u00a0additional open public comment periods on the topic of ticketing reform for the live entertainment industry.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><a href=\"https:\/\/americanorchestras.org\/wp-content\/uploads\/2025\/07\/Nonprofit-Performing-Arts-Ticketing-Comments-FTC-DOJ-7-7-2025.pdf\">Nonprofit Performing Arts Sector Comments Submitted by League and National Partners<\/a> <\/strong>\u2013 (07\/07\/24)<\/li>\n<\/ul>\n\n\n\n<p><strong>Congress Considers New Ticketing Laws<\/strong><br>Multiple legislative proposals with a range of approaches to this topic have been introduced in the U.S. Congress.<\/p>\n\n\n\n<p>In 2024, negotiations yielded two bipartisan approaches. Senate cosponsors introduced <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/senate-bill\/3457?q=%7B%22search%22%3A%22Blackburn%22%7D&amp;s=2&amp;r=1%22%20\\t%20%22_blank\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>S. 3457, the Fans First Act<\/strong><\/a>, which would prohibit the use of deceptive websites and speculative tix sales, and create new requirements for all ticket sellers to disclose all-in prices and fee details. On May 15, 2024 the House of Representatives approved <a href=\"https:\/\/docs.house.gov\/meetings\/IF\/IF00\/20231205\/116653\/BILLS-118-HR3950-M001159-Amdt-H3950_ANS_01XMLfiledbytheMajoritytoHR3950.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>H.R. 3950, the TICKET Act<\/strong><\/a>, which would create new transparency requirements for all ticket sales and restrict some harmful activity in the secondary market.&nbsp;Of the multiple legislative proposals considered by Congress in 2024, to date, the provisions of the Fans First Act have the strongest protections against harmful actions in the secondary market, as described in this <a href=\"https:\/\/static1.squarespace.com\/static\/5e91157c96fe495a4baf48f2\/t\/6642cfd9f5b6e03c648847bb\/1715654617168\/FTT-Congressional-Ticketing-Side-by-Side-v3.pdf\"><strong>side-by-side comparison of the bills<\/strong><\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>The House passed a reintroduced version of <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/house-bill\/1402\/text\"><strong>the TICKET Act, HR1402<\/strong><\/a>, on April 29,&nbsp;2025, once again sending decisions on next steps to the Senate for consideration.
