{"id":43133,"date":"2025-02-28T21:30:40","date_gmt":"2025-02-28T21:30:40","guid":{"rendered":"https:\/\/americanorchestras.org\/?p=43133"},"modified":"2025-03-07T14:09:13","modified_gmt":"2025-03-07T14:09:13","slug":"court-action-prompts-nea-updates-to-assurance-of-compliance","status":"publish","type":"post","link":"https:\/\/americanorchestras.org\/court-action-prompts-nea-updates-to-assurance-of-compliance\/","title":{"rendered":"Court Action Prompts NEA Updates to Assurance of Compliance"},"content":{"rendered":"\n<p>February 28, 2025<\/p>\n\n\n\n<p>As reported in the<strong>&nbsp;<a href=\"https:\/\/americanorchestras.org\/policy-action-plan-nea-updates-bipartisan-nonprofit-support-and-more\/#nea\">League&#8217;s Advocacy Update<\/a><\/strong>&nbsp;earlier this week,&nbsp;on Friday, February 21, a federal judge issued a&nbsp;<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mdd.575287\/gov.uscourts.mdd.575287.44.0_2.pdf\"><strong>preliminary injunction (PDF)<\/strong><\/a>&nbsp;blocking implementation of two executive orders (EO 14151, and&nbsp;EO 14173) attempting to terminate or change federal grants and contracts for programs related to diversity, equity, and inclusion.&nbsp;<\/p>\n\n\n\n<p>The National Endowment for the Arts (NEA) has updated its&nbsp;<a href=\"https:\/\/www.arts.gov\/grants\/legal-requirements-and-assurance-of-compliance#assurance\"><strong>Assurance of Compliance<\/strong><\/a>&nbsp;information to include the following language, stating that EO 14173,&nbsp;<em>Ending Illegal Discrimination and Restoring Merit-Based Opportunity,<\/em>&nbsp;will not apply to awards while the preliminary injunction is in effect. The timing of further court action, is not yet known.<\/p>\n\n\n\n<p>NEA Statement:\u00a0<em>PLEASE NOTE: Due to the preliminary injunction issued on February 21, 2025, by the United State District Court for the District of Maryland, Case No. 1:25-cv-00333-ABA, the NEA is not currently requiring any grantee or contractor to make any &#8220;certification&#8221; or other representation pursuant to Executive Order No. 14173.
