{"id":43974,"date":"2025-05-16T14:36:23","date_gmt":"2025-05-16T14:36:23","guid":{"rendered":"https:\/\/americanorchestras.org\/?p=43974"},"modified":"2025-05-16T14:36:25","modified_gmt":"2025-05-16T14:36:25","slug":"the-latest-news-on-charitable-giving-and-nonprofit-tax-proposals","status":"publish","type":"post","link":"https:\/\/americanorchestras.org\/the-latest-news-on-charitable-giving-and-nonprofit-tax-proposals\/","title":{"rendered":"The Latest News on Charitable Giving and Nonprofit Tax Proposals"},"content":{"rendered":"\n<p>May 16, 2025<\/p>\n\n\n\n<p>Orchestras and the wider nonprofit sector are speaking up as Congress considers tax policies that will have significant consequences for the future of charitable giving and nonprofits\u2019 capacity to deliver on mission.<\/p>\n\n\n\n<p>Congress is using the budget reconciliation process to extend many tax provisions from the 2017 Tax Cuts and Jobs Act (TCJA) that are set to expire at the end of 2025. The House Ways and Means Committee took action this week on a\u00a0comprehensive tax reform package that will undergo further changes as negotiations in Congress move ahead.<\/p>\n\n\n\n<p>What does this mean for the communities orchestras serve and the donors that support them?<\/p>\n\n\n\n<p>The\u00a0<a href=\"https:\/\/punchbowl.news\/wp-content\/uploads\/SMITMO_017_xml.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>full text of tax provisions<\/strong><\/a> is nearly 400 pages in length, and comparisons to current law are outlined in a\u00a0<a href=\"https:\/\/www.jct.gov\/publications\/2025\/jcx-21-25\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>report from the Joint Committee on Taxation<\/strong><\/a>. The League partners with national nonprofit coalitions and associations that have created the following helpful summaries:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/www.councilofnonprofits.org\/articles\/nonprofits-under-threat-whats-house-tax-bill-and-how-you-can-help\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>National Council of Nonprofits: What\u2019s in the House Tax Bill<\/strong><\/a><strong>\u00a0<\/strong><\/li>\n\n\n\n<li><a href=\"https:\/\/independentsector.org\/wp-content\/uploads\/2025\/05\/Ways-and-Means-Charitable-Sector-Provisions-5.13.25.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Independent Sector: Summary of Key Nonprofit Provisions<\/strong><\/a><\/li>\n<\/ul>\n\n\n\n<p>Among the many provisions that will impact the nonprofit sector, this week&#8217;s tax package includes policies that orchestras and other nonprofits have addressed in prior tax reform conversations and in the lead-up to the current negotiations on the Hill. Nonprofit organizations are calling on Congress to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Support new and expanded incentives for charitable giving<\/strong>: A version of The Charitable Act, long championed by orchestras and the wider nonprofit sector, was included in the House bill. The provision could <a href=\"https:\/\/charitablegivingcoalition.org\/viewnews.php?id=11\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>incentivize more giving<\/strong><\/a><strong>\u00a0<\/strong>among taxpayers that do not itemize their returns, providing a deduction of up to $150 for single filers, $300 for joint filers,\u00a0for\u00a0tax years 2025 through 2028 for contributions to a qualified charity.<\/li>\n\n\n\n<li><strong>Prevent policies that would diminish resources for the nonprofit sector<\/strong>: Provisions in the House bill could diminish giving by some high-income taxpayers\u2014those in the top 37 percent tax bracket\u2014that would be subject to a reduction in the value of their itemized deductions. The bill also significantly expands the <a href=\"https:\/\/cof.org\/sites\/default\/files\/documents\/files\/private\/2025-05-12-Private-Foundation-Excise-Tax-Infrastructure-Letter.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>private foundation excise tax<\/strong><\/a>, which would reduce dollars available for charitable organizations.<\/li>\n\n\n\n<li><strong>Protect tax-exempt status and benefits<\/strong>: A provision would reinstate a \u201cnonprofit parking tax\u201d that created a significant cost to orchestras and other nonprofits that offer parking and commuting benefits and that was <a href=\"https:\/\/americanorchestras.org\/ubit-rules-and-new-requirements\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>successfully repealed in 2019<\/strong><\/a>. As Congress aims to reduce fraudulent activity, new rules could prevent full access to long-delayed Employee Retention Tax Credit payments.
